All photographs, videos, edited images, digital files, and media content produced by Moments & Smiles Photography remain the intellectual property and copyright of Moments & Smiles Photography unless otherwise agreed in writing.

Client Usage Rights

Where copyright is transferred, ownership of the images or videos will pass to the client, and the client may use the images for commercial or business purposes. However, Moments & Smiles Photography may still retain the right to use the images for portfolio and promotional purposes unless otherwise agreed.
Portfolio and Promotional Use
Moments & Smiles Photography reserves the right to use photographs and videos for:
- Portfolio display
- Website
- Social media
- Advertising and marketing
- Studio displays
- Competitions or publications
If a client does not wish their images to be used for promotional purposes, they must notify Moments & Smiles Photography in writing before or at the time of booking.
Limitation of Liability
While every effort is made to provide high-quality photography and videography services, Moments & Smiles Photography shall not be held liable for circumstances beyond our control, including but not limited to equipment failure, weather conditions, venue restrictions, illness, accidents, or other unforeseen circumstances.
In the unlikely event of equipment failure, data loss, or other issues preventing delivery of images or videos, liability shall be limited to the amount paid for the services.

Terms and Conditions – Moments & Smiles Photography
By booking Moments & Smiles Photography for photography or videography services, you agree to the following terms and conditions.
Booking and Payment
A booking is confirmed once a deposit or booking fee has been paid and confirmation has been issued. The remaining balance must be paid before or on the day of the session/event unless otherwise agreed. Moments & Smiles Photography reserves the right to cancel bookings where payment has not been received.
Cancellations
If a client cancels a booking, the booking fee or deposit may be non-refundable as it secures the date and time. Rescheduling may be offered depending on availability.
Delivery of Images and Videos
Images and videos will be delivered digitally via an online gallery or download link within an agreed timeframe. Editing style and artistic decisions remain at the discretion of the photographer.
Copyright
All images and videos remain the copyright of Moments & Smiles Photography. Clients receive a personal usage licence unless a commercial licence or copyright transfer is agreed in writing.
Image Usage
Moments & Smiles Photography may use images for portfolio, website, social media, advertising, and promotional purposes unless the client requests otherwise in writing.
